Study shows how the brain responds to deceptive advertising

Several specific regions of our brains are activated in a two-part process when we are exposed to deceptive advertising, according to new research conducted by a North Carolina State University professor. The work opens the door to further research that could help us understand how brain injury and aging may affect our susceptibility to fraud or misleading marketing.

The study utilized functional magnetic resonance imaging (fMRI) to capture images of the brain while study participants were shown a series of print advertisements. The fMRI images allowed researchers to determine how consumers' brains respond to potentially deceptive advertising. "We did not instruct participants to evaluate the ads. We wanted to mimic the passive exposure to advertising that we all experience every day," says Dr. Stacy Wood, Langdon Distinguished Professor of Marketing at NC State and co-author of a paper describing the research.

Participants were exposed to three pre-tested advertisements that were deemed "highly believable," "moderately deceptive" or "highly deceptive." The ads were also pre-tested to ensure that they were for products that consumers found equally interesting and desirable ? leaving the degree of deception as the only significant variable.

"We found that people have a two-stage process they go through when confronted with moderately or highly deceptive ads," Wood says.

During the first stage, researchers saw increased activity in the precuneus ? a part of the brain associated with focusing conscious attention. "We found that the more deceptive an advertisement is, the more you are drawn to it," Wood says, "much as our attention is drawn to potential threats in our environment." Specifically, in this study, the more deceptive an ad was, the more precuneus activity was observed.

During the second stage, researchers saw more activity in the superior temporal sulcus (STS) and tempero-parietal junction (TPJ) regions of the brain. This suggests increased "theory-of-mind" (ToM) reasoning. ToM is a type of processing that allows us to distinguish our wants and needs from those of others, particularly as this applies to intuiting the intentions of other people. In this case, it appears to indicate that participants were trying to determine the truth behind the claims in the potentially deceptive advertisements.

"What's interesting here is that the moderately deceptive ads cause more activity during this second stage," Wood says. That may be because highly deceptive ads are screened out more quickly and discarded as not meriting further attention.

Overall, when looking at both stages of brain response, researchers found there was greater brain activation when participants were exposed to moderately deceptive ads. But, if moderately deceptive ads stimulate more brain activity, does that make us more susceptible to the sales pitch in ads that trigger just a pinch of skepticism?

Apparently not. In a follow-up, behavioral component of the study, researchers interfered with the ToM stage, making it more difficult for participants to determine the intention behind the ads. As a result, participants more frequently believed moderately deceptive advertising. This suggests that the second stage is an important step that helps protect consumers by allowing them to better discriminate and screen out deceptive ads.

"Now that we've identified these stages of brain response, it may help future researchers identify underlying neural reasons why some populations are more prone to fall prey to deceptive ads," Wood says. "For example, if these regions of the brain are likely to be affected by aging, it may explain why older adults are more vulnerable to fraud or deceptive advertising. Or how might concussive brain injuries, such as those seen in some sports, affect our long-term discrimination in making good consumer choices?"

After initially being dis-invited by the academy, Baron Cohen was allowed to attend the ceremony acting as the kind of Moammar Gadhafi parody he plays in his upcoming film, "The Dictator." As expected, he brought his unique brand of publicity stunt and method comedy.

It came at Seacrest's expense, though.

Flanked by two flower girls, he jokingly claimed to be carrying the ashes of the late North Korean leader Kim Jong Il, whose face was displayed on the container.

In an interview with Seacrest, he claimed it was Kim's dream "to be sprinkled over the red carpet and over Halle Berry's chest." Then, as Seacrest was bending down, he spilled the ashes over Seacrest's tuxedo.

Few maintain calm on the red carpet more than the awards show veteran, but even Seacrest looked shaken as he attempted to dust himself off.

As security muscled Baron Cohen away, Seacrest attempted to cut to commercial, but his E! colleagues sought to milk the incident. It quickly became the most-chatted about topic on Twitter, where commentators eagerly lapped up the rare breach in decorum at the Academy Awards.

Said Seacrest: "Anything can happen and it most certainly did, all over my lapel."

Advocates Press to Modernize Customary Laws, Tribal Leadership in Northeastern India

GUWAHATI, ASSAM, INDIA ? Pratima Kharsa, a young girl from the Dimasa tribe, became pregnant after falling in love with a local boy. But when the news spread throughout her village in Assam, a state in India?s Northeast region, he publicly rejected her and the child.

Per the local customary law ? law based on custom instead of legislation ? the village head called a meeting and forced Kharsa to publicly declare the name of the father of her baby in front of a priest and village elders.

"There are no rights for women in customary laws."

Parvati Thaosen, president of Shakti Mahila Mandal, a local women?s rights organization that works with tribes in the area, says custom dictated that Kharsa go into a nearby water body to declare the name.

After being named, the young man refused to accept her as his wife. Instead, he chose to pay a fine of 10,000 rupees ($200) to Kharsa for the child and married another girl.

?

?In majority of cases, men deny it and women have to face innumerable problems,? Thaosen says.

?

Months later, Kharsa gave birth to a daughter. She eventually married another young man in her tribe. But Thaosen says Kharsa was tortured in her new relationship, which came to a tragic end.

?Often, the couple used to have verbal brawl,? she says. ?To get rid of this, Kharsa one day sprinkled kerosene oil over her[self] and committed suicide.?

She says there are many other women like Kharsa in tribes across the region who suffer unfavorable living conditions because they have little say to change them under customary laws.

Many tribal communities in the ethnically distinct states of India?s Northeastern region ? Mizoram, Nagaland, Meghalaya, Arunachal Pradesh, Manipur, Tripura, Sikkim and Assam ? continue to regulate themselves according to their customary laws rather than India?s more modern federal constitution. Women?s rights activists say that many of these laws are gender-biased in composition and orientation. In many areas, they are constituted and interpreted by male elders alone, leaving little say or consideration for women. Activists are working to help them change the laws.

Customary laws are a set of rules that attain the force of law in a society because they are observed continuously and uniformly over a long period, says Mary Beth Sanate, a social activist and member of the Assam chapter of Women in Governance, a network of women?s organizations, human rights defenders, activists and journalists across the Northeast region that work for human and gender rights. They are the totality of customs of a tribe, which hands them down from one generation to the next.

Sanate says customary laws have endured many generations, despite varied opinions on them.?

?

?Some people are of the opinion that customary laws are primitive, archaic and mixed with superstitions,? she says. ?But it is a fact that customary laws have survived and continue to play dynamic roles in tribal communities.?

?

Customary law differs from statutory law, which is enacted by the government. But Sanate says that the government enables customary law to continue.

?

?[The] Government of India recognize[s] and allow[s] its existence, so many tribes in India continue with their own customary laws,? she says.

?

She says that tribes are proud of their laws that represent their distinct cultures and traditions, but that many of these laws discriminate against women.

?

?Amidst their diversity, [the customary laws] have some commonalities ? the most important being patriarchal, where women?s rights are denied,? she says.

News that a jury ordered Charlotte-Mecklenburg Schools to pay more than $1.1 million to a teacher whose career was ended by a rushed resignation had people asking who foots the bill.? Taxpayers?? An insurance company?

The verdict came in too late Friday to get an answer from CMS,? but I'll work on that Monday.? The budget includes about $2 million for the CMS legal department,? but I'm not sure whether that includes money set aside for settlements.

Some online commenters suggested that the verdict would wipe out teacher raises.? I don't think that's likely.? However it's handled,? CMS' financial folks know legal expenses are part of the cost of running a school district.? The award won't bust the $1 billion-plus budget.? Raises are much more likely to be torpedoed by the reluctance of county officials to raise taxes or slash services to come up with the $30 million interim Superintendent Hugh Hattabaugh is seeking for a 3 percent across-the-board bump.

The federal courthouse,? where I spent most of last week covering the teacher's suit,? is a digital desert (even cell phones aren't allowed in),? so I fell behind on blogging.? Here are some catch-up items.

* The target for hiring a superintendent has been pushed back from mid-March to early May.? Chair Ericka Ellis-Stewart says that allowed for three new members to take part in crafting a profile. The search firm will stop taking applications March 8;? after that there will be background checks, screening, narrowing the list and eventually a chance for the public to meet finalists.

*Chris Cobitz,? the CMS administrator who recently resigned after erroneous graduation-track data was included in the district's school progress reports, is now a senior associate with edCount, a Washington, D.C., firm that works with states and the U.S. Department of Education on assessment and accountability.

*Finally, I have learned that disabling the annoying "Prove you're not a robot"? CAPTCHA log-in does indeed allow computers to create comments about hot Latin girls, real naked celebrities and "galerie erotyczne prezeznaczone."? But since they're almost all landing in the spam filter, that's no skin off my (human) nose. I'm happy to let the robots slug it out.? One in seven Cambridge students is? dealing drugs to help pay their way through university, according to a survey.

It found many claim that they have been forced to sell illegal substances to friends to make ends meet as they study.

And it revealed nearly two-thirds admitted taking drugs, with cannabis the most? popular substance.

Q: My boyfriend and I had a great studio apartment for one year. It was our first place and we loved buying all of the little household items that make a house a home. I had a great job and, even though I was the only one working, my credit was good.

Then just a few months after we moved in, I was fired from my job and my boyfriend was still looking for work. I was unemployed for four months, but we still managed to pay rent, just not on time.

I finally got a low-income job and we struggled the rest of the year to pay rent. We paid partial rent throughout the month when we had some cash but not once did we pay the mounting late fees. Our landlord was sympathetic and ultimately waived the late fees, but said we couldn't renew our lease because of late payments.

We currently live with our parents and want to get another place soon because now we both have decent-paying jobs. How hard is it going to be to find another place because of our past rental history, even though we can afford to pay rent on time? Do you have any suggestions for us?

A: As many have learned in the last few years, building up your credit worthiness and the ubiquitous FICO score can take a long time, but can be destroyed very quickly. Of course, timing is a key component. The U.S. has just gone through a business cycle in which credit was clearly extended to too many people. Whether that is the fault of the borrowers or the lenders is the great debate now.

But at this time and with the economic downturn swinging the "easy credit" pendulum to the "tight credit" side, you are certainly not alone with this challenge. I am sure that you are anxious to get back to having a place of your own and it can be difficult to find yourself back home with your parents, but a lot of patience will be required.

I would suggest that you live below your means for a while in all aspects of your lifestyle and not just in your housing expenses. Your goal should be to live with your parents and live frugally in all ways until you can save up several months' worth of living expenses. By building a cash nest egg you will then be able to go out and search for a new place with the peace of mind that you can really afford to live there.

You should also be forthcoming with your new landlord and explain your situation. You may be surprised, but my experience is that most landlords are owners of investment property because they went through the same type of process of living below their means and were committed to delayed gratification, a concept that is exceedingly rare these days.

Of course, I am not suggesting that a savvy landlord will be willing to just listen to you describe your newfound financial approach and will hand you the keys! No, he or she will want you to pay a larger-than-normal security deposit to back up your story. You might even have to pay a security deposit that is equal to two months' rent so the landlord can be confident that another job setback will allow him or her plenty of time and the financial protection in case an eviction is necessary.

While I think there are many benefits for you and your boyfriend in my proposed plan, you could also increase your chances of finding a new landlord willing to rent to you if you have a co-signer. You may start out pursuing the "living below your means back at home with Mom and Dad" only to find that times have changed and the house you may have grown up in is no longer big enough.

In that case, your parents may be very willing to assist you as a guarantor or co-signer on a lease that would get you into your own place.

    LINCOLN, Neb. (AP) ? Seven states are asking a federal judge to block an Obama administration mandate that requires birth control coverage for employees of religious-affiliated hospitals, schools and outreach programs.

    The lawsuit in U.S. District Court of Nebraska alleges that the new rule violates the First Amendment rights of groups that object to the use of contraceptives.

    The rule, announced as part of the federal health care law, has come under fire from religious groups that object to the use of birth control. In response to the criticism, Obama administration officials have said they will shift the requirement from the employers to health insurers themselves.

    Nebraska Attorney General Jon Bruning says the proposed change still fails to address their concerns.

    Joining the lawsuit are Florida, Michigan, Ohio, Oklahoma, South Carolina and Texas.

    A 2004 California law permits DNA samples taken from adults arrested for felonies to be stored in a national database. Challengers said that violates Fourth Amendment privacy protections.

    A federal appeals court in San Francisco ruled Thursday that a California law requiring the taking of a DNA sample from every adult arrested for a felony does not violate the Constitution?s prohibition on unreasonable searches.

    The panel of the Ninth US Circuit Court of Appeals voted 2-1 to uphold the law, which permits the collected samples to be stored in a nationwide database for potential use in future investigations.

    Challengers had argued in a class-action lawsuit that the DNA law ? passed in 2004 as Proposition 69 ? would facilitate the use of their DNA samples in future investigations without the government first obtaining a warrant or reasonable suspicion. They said such actions violate Fourth Amendment privacy protections.

    ?We conclude that the government?s compelling interests far outweigh arrestees? privacy concerns,? wrote Judge Milan Smith in a 33-page decision joined by Senior District Judge James Dale Todd.

    In a dissent, Judge William Fletcher said the DNA law ignores an important distinction that he said applies to the collection of fingerprints.

    ?Fingerprints may be taken from an arrestee in order to identify him ? that is, to determine whether he is who he claims to be. But fingerprints may not be taken from an arrestee solely for an investigative purpose, absent a warrant or reasonable suspicion that the fingerprints would help solve the crime for which he was taken into custody,? Judge Fletcher wrote in his 27-page dissent.

    ?DNA samples are not taken from felony arrestees under Proposition 69 in order to identify them,? he said. ?Rather, they are taken solely for an investigative purpose, without a warrant or reasonable suspicion.?

    The taking and storage of such DNA samples, solely for future investigations, is invalid under existing legal precedents, Fletcher said.

    Fletcher also noted that all four of the plaintiffs were arrested for felonies but none were convicted. Two were not even charged.

    Judge Smith said Fletcher?s fingerprint and DNA analogy rested on an ?unprecedented and misguided reading of the Fourth Amendment.?

    ?Were he correct, our entire criminal justice system would be upended,? Smith said. ?For example, under our dissenting colleague?s theory, the police could never be allowed to match crime scene fingerprints to databases of prints collected from past arrestees.?

    A key issue in the case was the difference between the privacy interests of an arrestee versus the privacy interests of a convicted felon.

    Forty-seven states and the federal government authorize DNA collection from all convicted felons, while 22 states and the federal government allow DNA collection as well from at least some arrestees.

    Plaintiffs had argued that not all arrestees will be convicted. A mere arrestee maintains a higher level of Fourth Amendment protection from government intrusions than convicted felons, they said.

    ?We have never allowed the compulsory taking of DNA samples from mere arrestees. We should not begin now,? Fletcher said.

    The majority judges countered that the actual DNA collection was a ?minor inconvenience? involving a cotton swab scraped along the inside of a subject?s cheek.

    Such an intrusion is far less than others in a jail setting, like strip searches and monitored use of the toilet and showers.

    Smith said the DNA testing and storage program fulfilled four important government interests. It helped to identify arrestees, solve past crimes, prevent future crimes, and exonerate the innocent.

    The majority rejected concerns that DNA data might be misused or contribute to an all-knowing surveillance state. ?Although plaintiffs use the phrase ?DNA profile? to evoke images of an oppressive ?Big Brother? cataloguing our most intimate traits, the reality is far less troubling,? Smith wrote.

    California?s law and others include safeguards restricting the use of the data for law enforcement identification purposes only, he said, similar to the use of the fingerprint database.

    Study posits a theory of moral behavior

    Why do some people behave morally while others do not? Sociologists at the University of California, Riverside and California State University, Northridge have developed a theory of the moral self that may help explain the ethical lapses in the banking, investment, and mortgage-lending industries that nearly ruined the U.S. economy.

    For decades, sociologists have posited that individual behavior results from cultural expectations about how to act in specific situations. In a study, "A Theory of the Self for the Sociology of Morality," published in the February issue of the American Sociological Review, Jan E. Stets of UC Riverside and Michael J. Carter of CSU Northridge found that how individuals see themselves in moral terms is also an important motivator of behavior.

    Those bankers, stockbrokers, and mortgage lenders whose actions helped cause the recession were able to act as they did, seemingly without shame or guilt, perhaps because their moral identity standard was set at a low level, and the behavior that followed from their personal standard went unchallenged by their colleagues, Stets explained.

    "To the extent that others verify or confirm the meanings set by a person's identity standard and expressed in a person's behavior, the more the person will continue to engage in these behaviors," Stets said of the theory of moral identity she and Carter advance. "One's identity standard guides his or her behavior. Then the person sees the reactions of others to his or her behavior. If others have a low moral identity and do not challenge the illicit behavior that follows from a person's identity standard, then the person will continue to do what he or she is doing. This is how immoral practices can emerge."

    The sociologists surveyed a diverse group of more than 350 university students in a two-phase study that measured students' moral identity, assessment of specific situations as having a moral component, and moral emotions, such as guilt and shame. The students first were asked how they responded in specific situations where they had a choice to do the right or wrong thing; for example, copy another student's answers, drive home drunk, take an item, give to charity, allow another student to copy their answers, let a friend drive home drunk, return a lost item, or return money to a cashier.

    Three months later, survey respondents were asked how to rate each scenario in moral terms, and how they thought individuals ought to feel following doing the right or wrong thing in each situation. The students placed themselves along a continuum between two contradictory characteristics ? honest/dishonest, caring/uncaring, unkind/kind, unfair/fair, helpful/not helpful, stingy/generous, compassionate/hardhearted, untruthful/truthful, not hardworking/hardworking, friendly/unfriendly, selfish/selfless, and principled/unprincipled. The more that individuals endorsed themselves as honest, caring, kind, fair, helpful, generous, compassionate, truthful, hardworking, friendly, selfless, and principled, the higher their moral identity.

    Wherever individuals are located on this continuum, they act with the goal of verifying the meanings of who they are that is set by their moral identity standard, Stets and Carter said. "We found that individuals with a high moral identity score were more likely to behave morally, while those with a low moral identity score were less likely to behave morally. Respondents who received feedback from others that did not verify their moral identity standard were more likely to report guilt and shame than those whose identities were verified," they said.

    The goal is to live up to one's self-view however that appears across the moral continuum from being very uncaring and unjust to very caring and very just, the researchers said. "When the meanings of one's behavior based on feedback from others are inconsistent with the meanings in one's identity standard, the person will feel bad," they said.

    More research is needed to identify the source of moral identity meanings, Stets and Carter said. "Exposure to particular social contexts and individuals may encourage a higher moral identity," they said. "For example, when parents are involved in their children's lives, their children are more likely to recognize moral values. Schools can also sensitize individuals to moral meanings by providing an atmosphere that fosters justice, virtue, and volunteering. Religious traditions that promote reflection on moral issues and foster charitable work also help individuals recognize moral meanings."

    Studying the moral self is opportune given the practices of bankers, stockbrokers, and mortgage lenders whose behavior, in some cases, helped facilitate the recent recession in the United States, Stets and Carter said.

    "The cost of their irresponsible practices has touched the lives of many innocent victims, as witnessed in the loss of individuals' retirement savings, homes, and jobs. The fact that a few greedy actors have the potential to damage the lives of many (as evidenced in the Bernie Madoff case) brings issues of right and wrong, good and bad, and just and unjust to public awareness," they said. "To understand the illicit behavior of some, we need to study the moral dimension of the self and what makes some individuals more dishonest than others."
